CHILD MIGRATION
Subclass 101 Child Visa; Subclass 102 Adoption Visa
The processing time for visa finalisation at the Immigration Section in Athens will depend on how complete your application is. For your application to be complete please ensure you have addressed ALL the items in the checklist below. Failure to provide all documents at the time of making your application will result in delays in the processing of your application.
Medical examinations: you will need to undergo medical examinations with one of our panel doctors (examination and xrays if over 11 years of age and examination only if under 11 years of age). It is preferred that you do this prior to lodging your migration application, although please note that choosing to undergo medical examinations before your application is lodged and assessed as meeting the threshold criteria is your own responsibility. However, providing those medical results at the time of lodgement usually assists in processing your application as quickly as possible. Please note that medical examination expenses will not be reimbursed regardless of the outcome of your application.
Police clearance certificates (if over 16 years of age): you will need to provide police clearance certificates for all countries you have resided in for 12 months or more when you are lodging your application. We encourage you to apply for any police clearance certificates required as soon as possible as they may take time to obtain. For instructions refer to form 47P which can be found at: www.immi.gov.au/allforms/character-requirements/index.htm. Please lodge your Police Clearance(s) with your application.
Providing medical results and police clearance certificates at time of application will assist in processing your application as quickly as possible.
ALL APPLICANTS TO PROVIDE:
- Fully competed and signed application form 47CH from the applicant and sponsorship form 40CH from the sponsor
- Visa application charge (VAC). Advice regarding methods of payment of VAC is included in Migration Booklet no 2.
- If there is more than one child, each individual child must complete an application form (Form 47CH) and separate sponsorship forms (40CH) are to be provided however if the applications are lodged together, only one VAC is payable.
- Birth Certificate issued by the relevant authority in the country of your birth (usually Registrar of Births).
- Evidence that the sponsor is an Australian citizen or Australian permanent resident (i.e. certified copy of sponsor’s Australian passport, birth certificate or citizenship certificate).
- 4 x Passport sized photos of YOURSELF
- Marriage Certificate of YOUR PARENTS, if still in marital relationship
- Death certificate for your parent/s, if applicable
- Free to Marry Certificate for YOURSELF if you are over 16 years. This statement must be issued by the appropriate authorities (usually the Registrar of Births) and indicate whether you have been in marital relationship before. At the time of lodgement of your application you will be required to complete a local ‘Declaration concerning marital status’ form.
- Penal Check certificate for YOURSELF if over 16 years of age. The certificate must be the original, issued within the last four weeks. Bulgarian citizens must provide a 'Conviction Status Certificate' (Svidetelstvo za sjadmost). Albanian citizens must provide a Vertetim I Gjendjes Gjyqesore from the Ministry of Justice, Tirana, Albania.
APPLICANTS WHO ARE 18 YEARS OF AGE OR OVER TO PROVIDE:
- Evidence of the child’s dependency on the sponsor. This should include evidence of receipts of financial remittances over a substantial period and statements of the applicant, sponsor and relatives regarding the financial support provided.
- Evidence of continuing and current enrolment in studies (high school and college transcript, and/or certificate verifying current enrolment at current school, school or university booklet).
- Employment status certificate (i.e. workbook or employment certificate showing your current employment status and previous employment history, if any).
- If your sponsor is in full time employment in Australia, please provide Evidence of your sponsor’s Income. If your sponsor is not in full time employment, we may ask for an Assurance of Support.
- Your military book, military discharge papers and original documents relating to any injury and/or illness sustained during military service, and/or any injury or illness which has prevented you undertaking military service.
APPLICANTS UNDER 18 YEARS OF AGE TO PROVIDE:
- Divorce Certificate for your parents, if applicable.
- Evidence of custody for YOURSELF. This should be a court document showing which parent has legal custody of a minor child. If applicable, the transfer of custody court decision will also be required.
- Parent’s/Guardian’s Written Consent for Child to Migrate to Australia. This document must be signed by the non-migrating parent/guardian of a child under the age of 18, giving his/her consent for the child to migrate to Australia. Signing of the consent by the parent/guardian, even if that parent does not have custody, must be witnessed/certified by a court or by officials at the Australian Embassy Athens.
